Terms of Service

Last Updated: October 12, 2026

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at tpsurveying.com (the “Website”), operated by Total Precision Surveying (“TPS”, “we”, “our”, or “us”).

By accessing, browsing, or using our Website, including submitting inquiries or quote requests, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Website.

2. Nature of the Website

The Website is provided for informational purposes, allowing clients and prospective customers to learn about our surveying equipment sales, instrument repairs, calibration capabilities, training, and accessories.

The Website does not operate as an automated, immediate credit-card processing web shop. Instead, our catalog allows users to assemble equipment quote requests, which are reviewed by our technical staff to confirm availability, suitability, shipping details, and current commercial terms.

3. Equipment Catalog & Quote Requests

  • Quotes are Non-Binding Estimates: Submitting a quote request or adding items to the quote drawer does not constitute a completed sale, purchase contract, or guarantee of equipment reservation. All quotes are confirmed individually by TPS representatives in writing.
  • Inventory & Availability: While we endeavor to maintain an accurate and up-to-date catalog of new and certified pre-owned surveying instruments, all items are subject to prior sale, availability, and inspection.
  • Pricing & Specifications: Specifications, descriptions, and any indicative pricing displayed are subject to change without notice. Official pricing and terms will be provided on formal quotes or invoices issued directly by TPS.

4. Repairs, Calibrations & Service Inquiries

Information regarding instrument repairs, baseline calibrations, and servicing submitted through our Contact or Services pages represents an initial service inquiry. Formal repair scopes, turnaround schedules, parts replacement requirements, and calibration certification are established once instruments are received and physically evaluated at our facility in Sault Ste. Marie, ON.

5. Intellectual Property Rights

All content on this Website—including but not limited to text, photographs, site design, graphics, custom icons, and software—is the property of Total Precision Surveying or used with permission, and is protected by Canadian and international copyright and trademark laws.

Manufacturer names, product brandings, instrument models, and logos referenced on the Website (including third-party surveying brands and equipment manufacturers) are trademarks of their respective owners and are referenced solely for identification and compatibility purposes.

6. Employee Portal & Restricted Systems

Links to internal portals (including tpsnexus.tpsurveying.com) are intended exclusively for authorized employees, contractors, and administrators of TPS. Unauthorized access, automated credential attacks, or scraping of restricted portals is strictly prohibited and may result in legal action.

7. User Conduct & Prohibited Uses

When using this Website, you agree not to:

  • Submit false, fraudulent, spam, or misleading contact information or quote requests.
  • Attempt to compromise the security, integrity, or availability of the Website, servers, or connected systems.
  • Use automated scrapers, crawlers, or bots to harvest catalog or contact data without prior written authorization.
  • Use the Website in any manner that violates applicable municipal, provincial, federal, or international laws.

8. Disclaimer of Warranties

The Website and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. TPS makes no representations or warranties that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

Warranties for purchased surveying equipment, certified pre-owned units, and repair workmanship are governed exclusively by TPS’s specific written sales agreements, manufacturer terms, and formal service invoices, not by general text appearing on this Website.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Total Precision Surveying, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to, use of, or inability to use this Website, even if advised of the possibility of such damages.

10. Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to the Website shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal proceedings shall be instituted in the courts of Ontario, Canada.

11. Changes to These Terms

We reserve the right to revise and update these Terms at any time without prior notice. Any updates will become effective immediately upon posting to this page with an updated “Last Updated” date. Your continued use of the Website following changes indicates your acceptance of the revised Terms.
